DAMAGE WAIVER AGREEMENT

Photo Booth & Party Rental Equipment Damage Waiver Fee

Optional Damage Waiver

Customers may elect to purchase a Damage Waiver for a fee equal to ten percent (10%) of the total replacement value of the rented equipment. The fee applies to all items rented under a single order. The Damage Waiver is NOT insurance.

If the Customer has purchased and paid in full for the Damage Waiver, and remains in full compliance with all terms and conditions of this Rental Agreement, the Company agrees to waive claims against the Customer for certain direct, accidental physical damage to rented equipment that occurs during normal and proper use.

This waiver applies only to minor, non-negligent, and repairable damage, including but not limited to:

  • Minor scuffs or surface scratches resulting from ordinary use

  • Small chips or cracks that do not affect functionality

  • Minor tears or stains on linens that are reasonably cleanable or repairable

  • For photo booth rentals:

    • Minor cosmetic scratches or dents to the booth structure or accessories

    • Accidental bumps or incidental spills occurring around the booth

    • Minor, repairable damage to cords or accessories

    • Accidental tilting of tripods, stands, or enclosures, provided such incidents are not caused by relocation, improper handling, or misuse

The Company reserves the sole right to determine the extent of damage and whether it qualifies under this waiver.

Acceptance of the Damage Waiver requires payment of the full fee prior to release of equipment.

The Damage Waiver Does Not Cover:

(a) Loss, theft, , or failure to return equipment for any reason
(b) Damage caused by improper use, misuse, abuse, negligence, or failure to follow provided instructions
(c) Damage resulting from failure to properly secure, store, or supervise equipment
(d) Damage to motors, wiring, electrical components, or devices caused by artificial current, improper power supply, or electrical misuse
(e) Damage resulting from vandalism, malicious mischief, or intentional acts
(f) Fire, excessive heat, rain exposure, flooding, or weather-related damage when equipment is not properly protected
(g) Outdoor photo booth setup without adequate covering or weather protection
(h) Overloading or exceeding rated capacity
(i) Damage resulting from violation of this Rental Agreement or any applicable law

If Customer carries personal or event insurance covering such damage, Customer agrees that such insurance shall be primary, and the Damage Waiver shall be secondary. Customer agrees to cooperate in processing any applicable insurance claims and assign any proceeds related to rented equipment to the Company.

By checking the box, Customer acknowledges understanding of the Damage Waiver terms and elects to add the Damage Waiver to their rental order.
